Violation of the order dated 1st May, 2023 is alleged by the petitioner.

The petitioner alleged that despite the order dated 1st May, 2023, the alleged contemnors obstructed holding Durga Puja at his place for 2023. The contempt application has been filed in May, 2024.

This Court is of the view that with the passage of time, the contumacious act if at all has been condoned by the petitioner himself.

The Sainthia Police Station shall, however, ensure that the petitioner is able to hold Durga Puja in future and is not disturbed from enjoying is property as directed in the order dated 1st May, 2023 passed in WPA 22272 of 2022.

With the aforesaid observations, CPAN 662 of 2024 shall stand disposed of.

6.

There shall be no order as to costs.

7.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
