Sushanta Tangi And ANR. v. State Of West Bengal
AD 46 April 28, 2026 Ct. 28 SG CRM(A) 1251 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pursurah P.S. Case No.287 of 2025 dated 18.11.2025 under Section 126(2)/115(2)/117(2)/109(1)/352/351(2)/3(5) of the BNS, 2023.
And In the matter of: Sushanta Tangi and another ... petitioners Mr. N.S. Ghosh Ms. Labani Sikder Mr. Souvik Dey ... for the petitioners Mr. Prasun Kumar Dutta Mr. Pravas Bhattacharya ... for the State Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statements of witnesses including the victim and the medical report which shows fracture of underlying bone in the occipital region. Considering the above and the other materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
