Learned advocate appearing for the State submits a report dated July 2, 2021 which be taken on record.
The writ petition was taken up for consideration on June 28, 2021 when a report was called for. The report dated July 2, 2020 which is taken on record is in pursuant to such direction. The report dated July 2, 2021 states that a fresh visit was conducted on July 1, 2021 and during enquiry the police gathered from the local people that no development as to the physical nature, character and possession in respect of the land could be seen. The petitioners were also not seen in and around the land in dispute.
Learned advocate appearing for the State submits that the petitioners suppressed the fact that there is a Civil Suit being Title Suit No. 228 of 2021 pending before the learned Civil Judge (Junior Division), 3rd Court, Baruipur, 24- Parganas (South). In such circumstances, since there is a Civil Suit pending between the private parties and since the police took steps as noted in the report dated July 2, 2021, no further interference is called for.
W.P.A. 10475 of 2021 is disposed of accordingly. No order as to costs.
