The instant application under Article 227 of the Constitution of India is at the instance of the defendant in a suit for eviction of a tenant which is directed against the Order No. 68 dated April 01, 2024 passed by the learned Civil Judge (Junior Division) at Nabadwip, District: Nadia, in the said suit being Title Suit No. 59 of 2019.

The learned Trial judge by the order impugned has dismissed an application for amendment filed by the defendants at the argument stage; in view of the stage of the suit, the dismissal is justified.

C.O. 1279 of 2024 is thus dismissed without any order as to costs.

The disposal of the suit be expedited.
