Mr. Anamitra Banerjee, Mr. Musharraf Alam Sk, Mr. Sk Sarfaraj Nawaj ... For the Petitioner.

Mr. Sagar Saha ... For the State.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 120 days and he has been detained on the basis of statement of co-accused. There has been no recovery from the present petitioner. Mr. Sagar Saha, learned advocate is directed to represent the State. His appointment may be regularised by the concerned authorities.

Learned advocate for the State has produced the case diary along with Memo of Evidence.

Reference has also been made by the petitioner to the order dated 30.03.2026 passed in CRM (A) 395 of 2026 in respect of one Samrat Ghosh @ Subrata. Be that as it may, the petitioner is in custody and the investigation of the case is in progress. If there is no recovery from the present petitioner and/or any CDR or money trail reveal in course of the investigation, learned Special Court will release the

petitioner viz., Abhijit Ghosh @ Avijit Ghosh on bail after the investigating agency submits charge-sheet before the jurisdictional court.

With the aforesaid observations, the application for bail, being CRM (NDPS) 817 of 2026, is, thus, disposed of. Memo of Evidence submitted on behalf of the State be kept with the record.

Case diary be returned to the learned advocate appearing for the State.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
