Mr. Salam, learned advocate appears on behalf of petitioners and submits, this is a case of police inaction. His clients had approached the Magistrate and obtained order under section 144 (2) of Code of Criminal Procedure, 1973. He refers to page 15, which is order dated 6th August, 2020 made by Sub-Divisional Executive Magistrate, Krishnagar, Sadar, Nadia, inter alia, directing Nabadwip Police Station to ensure that there should not be any illegal construction over suit property. Mr. Deb Roy, learned advocate, Additional Government Pleader, appears on behalf of State and hands up communication dated 3rd September, 2020, made by Inspector-in-Charge, Nabadwip Police Station to the Public Prosecutor saying, as of now, no new construction work is being carried out.
