The petitioner is an employee of the railways. He was implicated in a disciplinary proceeding. The petitioner intends to obtain certain information under the Right to Information Act, 2005. The same was refused on the grounds that third party information cannot be provided. The petitioner preferred a first appeal, but the order of the Information Officer was upheld. The second appeal is pending consideration.

The petitioner submits that the information sought for will be required in connection with the original application which is pending consideration before the Central Administration Tribunal, Kolkata Bench.

Learned counsel for the railways submits, upon instructions, that the information that has been sought for does not relate to the petitioner, and that the same are third party information which cannot be supplied.

As the petitioner submits that the information will be required by him for the purpose of submission

of a meaningful rejoinder before the Central Administrative Tribunal, accordingly, it will be open for the petitioner to renew his prayer for supply of the documents of the respondents before the Tribunal. No relief can be granted to the petitioner in the instant writ petition.

The writ petition fails and is hereby dismissed. 6.
