Versus

The State of West Bengal & Ors.

Mr. Dibeyndu Chatterjee, Ms. Piyali Paul ...for the Petitioner.

Ms. Sutapa Sanyal, Ms. Susnita Saha ...for the State-respondents.

Despite service of notice upon the respondent Nos.6 and 7, none appears on their behalf. No accommodation is prayed for. The police report is taken on record. The police authorities have admitted in their report that the learned Civil Judge (Senior Division), 2nd Court at Tamluk, Purba Medinipur, had passed an order on February 11, 2021, directing the Officer-in-Charge Nandakumar Police Station, to render necessary help for implementation of the order of injunction. An enquiry was made by the concerned Sub-Inspector of police and prosecution under Section 107 of the Code of Criminal Procedure against the respondent Nos.6 and 7 was submitted. The respondent Nos.6 and 7 have been asked to maintain peace.

This Court is of the view that an order of injunction passed by a civil court must be implemented. It is a matter of

public policy that the order must be complied with by the parties. Direction upon the police had also been issued. The police authorities shall ensure that the order of injunction, which has been passed by the learned Court below, is implemented in its letter and spirit.

The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order or on the communication of the learned Advocates. (Shampa Sarkar, J.)
