The petitioners claim to be the owners of LR Plot Nos. 270, 246 and 406 within Mouza - Bhagyabantapur, PS - Sutahata, East Midnapur. The petitioners claim to have received a notice under Section 3(1) of The Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 for using the land of the petitioners for the purpose of Haldia-Panagarh-LPG Pipeline Project. The petitioners

raised an objection against the action of the respondent authorities in laying the pipeline underneath the property of the petitioners.

Learned advocate appearing for the petitioners submits that a notice of hearing was issued to the petitioners and the petitioners duly attended the said hearing, but no decision has been communicated to the petitioners till date.

Learned advocate appearing for the respondent nos. 2 and 3 submits that the authorities have not yet taken steps for installing the pipelines on the property of the petitioners. He, therefore, submits that the instant writ petition is a premature one and compensation will be paid in accordance with the provisions of the 1962 Act if the property is utilized by the respondent authorities.

Learned advocate appearing for the respondents is directed to serve a copy of the order passed by the authority pursuant to the hearing conducted on the claims and objections raised by the petitioners by tomorrow, i.e., by November 12, 2025.

A copy of the order dated October 4, 2023, October 6, 2023 and October 17, 2023 is taken on record.

In view of the stand taken by the respondent authorities, there is no necessity to pass any further order at this stage.

With the above observations and directions, this writ petition stands disposed of.
