In re : CAN 2 of 2022 Sufficient grounds were available for explaining the absence of the writ petitioners on 10th December 2019 passed by a Co-ordinate Bench of this Court in W.P.A. No. 8189 of 2013 (Ravi Krishan Kapur, J.). Hence, the said order is recalled.

WPA 8189 of 2013 is restored to its file and number.

CAN 2 of 2022 shall stand allowed.

In re : WPA 8189 of 2013 Affidavit of service filed in Court be taken on record.

The petitioners participated in the 12th RLST for the year 2011. The model answer keys to the OMR questions for the TET examination have been found to be incorrect.

In that view of the matter, let an expert committee be appointed in respect of the subject matters of the said TET examination for year 2011 by the Head of the Department of the Education Department, Jadavpur University.

The WBCSSC shall obtain the opinion of the aforesaid experts in terms of the order dated 27th June 2019 passed in WPA 450 of 2013. The Commission may take suitable steps in terms of the opinion of the experts upon intimation to the learned advocate for the petitioners. If the answer key to the questions in the OMR sheets are found incorrect or more than one answer is found correct, the Commission shall award marks to the concerned candidates for each of such question. Consequential benefits shall also follow to the candidates who are found to have been obtained additional marks pursuant to such process.

It is expected that the aforesaid exercise shall be completed within a period of 6 weeks from date. With the aforesaid observations, the writ petition stands disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
