In this application the petitioner has made an innocuous prayer for expeditious disposal of the complain filed by the petitioner under section 12 of the Protection of Women from Domestic Violence Act, 2005, being Misc. Case No. 390 of 2022 presently pending before the learned Judicial Magistrate, 4th Court, Durgapur.

Being aggrieved by the inordinate delay caused in disposal of the said application, learned counsel for the petitioner submits that the application under section 12 of the said Act was filed in the year 2022, when interim maintenance was also granted in favour of the petitioner. But since then, the proceeding has not been advanced any further. In such circumstances, she prayed for necessary direction upon the court below to expedite the proceeding. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

In view of the submission made by the petitioner and that an application under section 12 of the said Act is required to be disposed of within a statutory period, I find that the prayer made by the petitioner is justified and required to be allowed for securing the ends of justice. In view of the above, the instant application being CRR 1757 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the proceeding and to make its best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing without granting any unnecessary adjournment to either of the parties.
