The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure after being arrested in connection with Baguihati P. S. Case No. 211 of 2021, dated 02.05.2021 under Sections 498A/306 of the Indian Penal Code. Pursuant to the order dated 1st June, 2021, the Investigating Officer is personally present along with the report detailing the status of the investigation. The personal appearance of the Investigating Officer is dispensed with.

Our attention is drawn to the statement of the minor son recorded under Section 164 of the Code of Criminal Procedure, which was not recorded when the interim bail was granted by this Court. Precisely for such reason, the matter was fixed today. Since the statement of the minor victim child has been recorded under Section 164 of the Code of Criminal Procedure and

on perusal thereof, we find materials in support of the bail which to be granted to the petitioner.

Accordingly, the interim bail granted to the petitioner is hereby confirmed.
