The petitioner is complaining that she has lodged a complaint with the Inspector-in-Charge, Rampurhat Police Station, District. Birbhum, the respondent no. 2 herein alleging criminal acts of one Sakil Seikh, the respondent no. 3 herein, but respondent no. 2 has not registered the said complaint as First Information Report.
The petitioner is praying that the respondent no. 2 may be directed to register a criminal case against the respondent no.3 by treating her said complaint as FIR. It is always open for the petitioner to approach the concerned Magistrate for a direction to take cognizance of any offence in terms of Section 156(3) of the Code of Criminal Procedure.
The jurisdiction under Article 226 of the Constitution of India cannot be exercised when an efficacious alternative remedy is available to the petitioner for the redressal of her grievances.
W.P.A. 10494 of 2021 is disposed of with the above observation without any order as to costs.
