This matter relates to a new electricity connection, application for which has been made by the petitioner to the CESC. The CESC by its letter dated 19th August, 2020 has intimated the petitioner that their authorized personnel were unable to carry out the inspection of the said premises as the meter board room/position was not accessible.

After hearing the parties and after considering the pleadings, I am of the opinion that under no circumstances the petitioner can be deprived of electricity connection. The respondent no.3 being the Officer-inCharge, Manicktala Police Station, shall extend all help to the CESC personnel to access the meter board room and if any resistance is given by the landlord being the

respondent no.4, the landlord should be restrained in accordance with law so that the petitioner cannot be deprived of his fundamental rights guaranteed under Article 21 of the Constitution of India. This action is to be completed by the CESC by 2 weeks from date and it is expected that to avoid further serious consequences, the respondent no.4 shall not prevent CESC to install or give a new connection to the petitioner.

With the above direction the writ petition being WPA 7056 of 2020 is disposed of.
