APP Mr. Sabir Ahmed ... ...For the State The learned advocate appearing for the State has placed before us the report sent to the office of the Learned Public Prosecutor by the Officer-incharge, Dum Dum P.S. It is submitted on the strength of the report that the victim girl was recovered and a statement under section 164 Cr.P.C. was recorded from her. It is further submitted that in furtherance of the disclosure made in that statement and on further investigation, final report has been lodged before the competent criminal court as against the person with whom she had gone on her own will. It is submitted that she being a minor, the statement of consent and the consensual marriage is not to be acted upon.
We record the submissions and, particularly, the fact that the victim girl has been recovered. This should bring an end to the writ petition seeking issuance of a writ in the nature of habeas corpus. We accordingly dispose of this writ petition without prejudice to the proceedings, if any, pending in any appropriate jurisdiction, touching the issues. (Thottathil B. Radhakrishnan, C.J.)
