Petitioner is directed to serve a copy of the revisional application upon Mr. Soumik Ganguly, learned advocate, who ordinarily appears on behalf of the State. His appearance may be regularised by the concerned authorities.
Petitioner is an accused in connection with Amdanga Police Station Case No.524 of 2022 dated 06.10.2022 under Sections 498A and 406 of the Indian Penal Code. Learned advocate appearing for the petitioner submits that charge-sheet has already been submitted and document under Section 207 of the Code of Criminal Procedure has been handed over and the next date has been fixed by the learned ACJM, Barasat on 12th March, 2024 for consideration of charges.
Having considered the fact that the learned trial court is yet to overcome the stage of consideration of charges, I direct the learned trial court would on the next date so fix take efforts for completing the process of consideration of charges, in case the same is not possible on the next date within a month thereafter the
consideration of charges should be completed. If after consideration of charges the learned trial court is of the opinion that the trial is to be commenced, under such situation, the learned trial court would fix at least one date in every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. In case there is dearth of the availability of the witnesses, the learned trial court would be at liberty to communicate with the Inspector-in-Charge of Amdanga Police Station who would take steps for ensuring the availability of the witnesses concerned. No unnecessary adjournment should be granted to either of the parties. The public prosecutor conducting the case would ensure regarding the production of the materials, exhibits and documents available on the dates so fixed for examination of the witnesses. All stakeholders would co-operate with the learned trial court so that the trial is concluded at the earliest. With the aforesaid observations, CRR 1442 of 2023 is disposed of.
Pending connected application, if any, is consequently disposed of.
