The instant writ petition has been filed by the petitioner to give effect of his representation dated 17th February, 2012 wherein he stated that he wanted to set up a brick field on a particular piece of land and he may be permitted to grant certificate for running such brick field.

It is needless to say that excavation of earth for the purpose of preparation of brick and construction and furnace system is a minor mining operation which is now governed under the West Bengal Minor and Mineral Concession Rules, 2016. If the petitioner wants to set up any brick field, he is required to takes step under the West Bengal Minor and Mineral Concession Rules, 2016. With this liberty, the instant writ petition is disposed of. It is clearly recorded that at this stage this Court is not in a position to give any relief on the application dated 17th February, 2012 filed by the

petitioner to the Additional District Magistrate and DL & LRO, Malda.
