1. Affidavit of service is filed and the same be kept with the record. From the record it is found that on two repeated occasions notice was served upon the opposite parties, but none appears.

2. This revisional application has been filed assailing the order dated 9th February, 2023 passed by the learned Judicial Magistrate, 2nd Court, Howrah issuing warrant of arrest against the petitioner/accused for non-appearance on 09.02.2023 just after released on bail on 10.11.2022.

3. Mr. Satadru Lahiri, learned advocate appearing on behalf of the petitioner has submitted that petitioner/accused was released on 10.11.2022 and next date was fixed on 9th February, 2023 for appearance, but on that date petitioner/accused could not appear due to his illness which has been substantiated by

document annexed with this revisional application.

4. Considering all facts and circumstances, I am inclined to set aside the order impugned with a direction upon the petitioner/accused to surrender before the Court within one week from the date and petitioner/accused be allowed remain on the same bail bond already furnished on 10.11.2022.

5. With the aforesaid observation, the CRR 1444 of 2023 stands disposed of.

6. All parties to this revisional application shall act on the server copy of this order downloaded from the official website of this Court.
