W.P.A. 9558 of 2025 Krishna Rao.

VS The State of West Bengal & Ors.

Mr. Debasis Kar, Mr. Husen Mustafi.

...for the petitioner.

Mr. Vivekananda Bose, Mr. Arindam Mitra.

...for State.

Affidavit-of-service filed by the petitioner be kept 08.05.2025 Court No. 35 Item No.305 Rakib with the record.

Petitioner is aggrieved since the police authorities are not complying with the injunction order passed on 13.09.2024 in connection with T.S. 624/2024.

Learned advocate appearing for the State on the other hand submits that since there are no direction upon the police authorities, police authorities are only overseeing relating to the violation of any law and order involved.

I have perused the documents enclosed alongwith the writ petition and I find that there was an injunction order. However, there was no direction upon the police authorities to act in a particular manner. Under such circumstances, I am of the opinion that if the petitioner is so advised, petitioner would take out an appropriate application for rendering police assistance before the Civil Court in connection with T.S. 624/2024. If any direction is passed upon the police authorities, the police

authorities would respect, obey and implement the said order.

In the meantime, police authorities would only oversee that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties. With the aforesaid observations WPA 9558 of 2025 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
