Mr. Mit Guha Roy ....for the petitioner This application under Article of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 6th Court at Alipore to dispose of the Matrimonial Suit No.891 of 2021 expeditiously. The learned advocate appearing for the petitioner submits that the wife/opposite party herein has not filed any application for payment of alimony. He further submits that the matrimonial suit is at the peremptory hearing stage.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates appearing before the learned trial judge.

The learned advocate for the petitioner, in his usual fairness submits that the learned Presiding Officer will retire in this month.

In view thereof, no useful purpose would be served by passing a direction for expeditious hearing at this stage.

The learned advocate appearing for the petitioner submits that liberty be given to the petitioner to approach the learned District Judge for appropriate relief.

In the light of the submission made by the learned advocate for the petitioner CO 1463 of 2025 is disposed of by giving liberty to the petitioner to make an appropriate application before the learned District Judge and if such an application is made, the learned District Judge is requested to consider the same and pass an order accordingly.

There will be no order as to costs.
