Learned counsel appearing on behalf of the petitioner submits that the petitioner is an aged person. There was a long standing civil dispute between the private parties. This led to a scuffle between two groups. The petitioner also received serious injuries. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the statements of the victim and the other witnesses. He also relies on medical papers of the 66 year old victim, who had to remain hospitalized for ten days. Among other things, there was a fracture of leg, which had to be surgically fixed.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner. The application for anticipatory bail of the petitioner is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
