Kausik (Rejected) CRM (M) 1029 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Goghat Police Station Case No. 37 of 2026 dated 23.01.2026 under Section 126(2)/351(3)/74/75 of BNS, 2023 and under Sections 8/12 of the POCSO Act, 2012.

Affidavit of service filed be kept with the record. Learned advocate appearing for the petitioner submits that petitioner is in custody for 156 days and the present case arose because of a relationship existing. Charge sheet has already been submitted, as such the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 183 of the BNSS.

Case records reflect that petitioner was also earlier involved in a case under Section 6 of the POCSO Act. Considering the antecedent of the present petitioner, I am not

inclined to release the petitioner on bail at this stage prior to the evidence of the victim being concluded.

The learned Trial Court would expedite the process of consideration of charges preferably within a period of 15 days from the next date fixed and thereafter within a month complete the evidence of the victim.

With the aforesaid observations CRM (M) 1029 of 2026 is dismissed.

Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
