Shrabanti Halder And ORS v. State Of West Bengal And ORS.
06/07/2021 Item No. 4 Court No.8.
S. DE Through Video Conference W.P.A. 10506 of 2021 Shrabanti Halder & Ors.
Versus
The State of West Bengal & Ors.
Mr. Jayanta Samanta, Mr. Karunamoyee Samanta, ...for the petitioners.
Mr. Subhabrata Datta, Mr. Debashis Sarkar, ...for the State.
The petitioners complain that, they were not heard before the authority taking the decision. Learned advocate appearing for the State submits that, the allegations of not hearing the petitioners are without any basis. The petitioners were issued notices and that they chose not to appear. Be that as it may, without entering into the dispute as to whether the petitioners were served with a notice of being and whether the petitioners were prevented by sufficient cause for not appearing before the authority on the fixed date and time, it would be appropriate to request the appropriate authorities to hear the petitioners once more. The authorities will hear the petitioners on July 9, 2021 at 11 A.M. These
dates and times are fixed at the invitation of the learned advocate for the petitioners. No further notice of hearing need be given to the petitioners in view of the fact that the dates and times are being fixed in presence of the learned advocate for the petitioners and at his instance.
The petitioners are at liberty to appear before the authority through an advocate. In the event, the petitioners do not appear on July 9, 2021 on the time fixed, the authorities are at liberty to take a decision, in accordance with law.
W.P.A. 10506 of 2021 is disposed of, accordingly.
No order as to costs.
Urgent certified Website copy of this order, if applied, be supplied to the parties, upon compliance of all requisite formalities.
