1. The petitioner who is a practicing advocate of this Court has filed the present writ petition so as to direct the Municipality to respond to the information sought for by the petitioner as regards the recording, if any, of her date of birth in the office records of the Municipal Corporation.

2. The petitioner claims that the petitioner was born on 25th April, 1939 and was enrolled as an advocate in the Bar Council of West Bengal on 4th August, 1970 vide enrollment No. WB/366/1970. Such fact would corroborate from the identity card issued by the Bar Council of West Bengal counter signed by the Chairman on 9th May, 2000. A copy of such document as placed before this Court is taken on record.

3. The petitioner claims to have also deposed before the learned Executive Magistrate, Kolkata claiming that as per her knowledge which she has gathered from her late parents during their lifetime, she was born at

P-54 Raja Basanta Roy Road, KMC, Ward No. 69, P.S.- Kalighat, Kolkata-700026 on 25th April, 1939. She has also deposed that her delivery took place at home and her father's name is Late Ashoke Nath Mukherji and her mother's name is Late Anupama Mukherji. This date of birth has been recorded in all contemporaneous documents of the petitioner including her passport. A copy whereof as placed before this Court is also taken on record.

4. When the matter was taken up for hearing on 7th June, 2026, this Court had called upon the Municipality to take appropriate instructions in the matter. Today, the learned advocate for the Municipal Corporation has placed before this Court a report dated 11th May, 2026 duly counter singed by the Sub-Registrar, Health Department, Kolkata Municipal Corporation and the Chief Municipal Officer, Kolkata Municipal Corporation, and would submit that from the above report, it would be apparent that no record of the birth event of a female baby of Ashoke Nath Mukherji and Anupama Mukherji is found in the records of the Municipal Corporation. The Municipality has also not been able to locate any register as regards the above birth event and as such the information was not furnished. Let a copy of the aforesaid report as placed before this Court be taken on record.

Having regard to the above disclosure, I am of the view that since the birth event of the female child of Ashoke Nath Mukherji and Anupama Mukherji as aforesaid is not found in the records of the Municipal Corporation, the aforesaid report should be treated as a communication issued by the Corporation to the petitioner and the matter should be brought to close.

6. With the above observations and directions, the writ petition is disposed of.
