The petitioner participated in the process of offering premises to the LICI in terms of the notice inviting bids dated 22.01.2021.

The petitioner submits that his premises is fully constructed and has been inspected and found otherwise fit for consideration by the LICI. However, after opening of the financial bids the private respondent no. 5 has been selected by the LICI. By reference to a photograph of the premises offered by the private respondent no. 5, it is submitted that the said premises has not even been complete. This Court cannot countenance any photograph along with the writ petition under normal circumstances.

The process of tendering and assessment of bids has not been challenged by the petitioner.

Indeed there is no flaw or discrepancy found by this Court in such

process as set out in the writ petition. Since the decision making process has not been found to be inappropriate, the final decision is generally not interfered with by a writ court under Article 226 of the Constitution of India. In any event, the suitability of the premises for its occupation is within the exclusive domain of the LICI and the petitioner cannot impose his premises upon the LICI.

In view of the above case, no relief can be granted to the petitioner.

Hence the writ petition is dismissed.

There will be no order as to costs.
