CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1486 of 2011 In the matter of : An application under Section 482 read with Section 401 of the Code of Criminal Procedure; And In Re: Sri Manab Chandra Bera ......Petitioner.
The present revisional application has been preferred against the order dated 31.01.2011 passed by the Learned Chief Judicial Magistrae, Purba Medinipur in Misc. Case No. 199 of 2004.
The order dated 31.01.2011 passed by the Learned Magistrate reflected that the application under Section 125 of the Code of Criminal Procedure was allowed on contest, after evidence was adduced by both the parties. The Learned Magistrate, on appreciation of such evidence, awarded maintenance at the rate of Rs. 2,000/- per month to the wife and Rs. 1,500/- each per month for the two children.
Having regard to the quantum, which was awarded by way of maintenance, I am of the view that no interference can be made at this belated stage.
Consequently, the revisional application being CRR 1486 of 2011 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
