Kausik (Allowed) CRM (NDPS) 830 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhimpur Police Station Case No. 190 of 2024 dated 14.07.2024 under Section 21(c)/29 of the NDPS Act, 1985.

Learned advocate for the petitioner has referred to order of the Hon'ble Supreme Court passed in SLP (Criminal) No. 10561 of 2026 and submitted that the person, from whom contraband has been seized, has been released by the Hon'ble Supreme Court. According to the learned advocate for the petitioner, so far as the present accused is concerned, his complicity is statement of co-accused and certain bank documents relating to money trail and call detail records. Learned advocate for the State opposes the prayer for bail and submits that there are call detail records and money trail, so far as the present petitioner is concerned. However, the learned advocate is unable to refute the contention that Bapan

Halder and Laxman @ Lakshman Ghosh are not on the same footing, if not better.

Having regard to the fact that the other accused person has been granted bail by the Hon'ble Supreme Court, I am inclined to release the petitioner on bail.

Accordingly prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Laxman @ Lakshman Ghosh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Special Judge (under NDPS Act), Nadia, Krishnanagar.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court. Server copy of the order of the Hon'ble Supreme Court relied upon by the learned advocate for the petitioner be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
