Criminal Revisional Jurisdiction C.R.R 1312 of 2021 Dinesh Sukhabhai Surti & Ors.

-versus- M/s. Cholamandalam Investment & finance Co. Ltd. Re : An application under Section 482 of the Code of Criminal Procedure. The revisional application was preferred challenging the proceedings being CS /1986/2021 pending before the Learned Metropolitan Magistrate, 7th Court, Calcutta. In view of the tenor of the contentions in the revisional application, I find that the interim order which was passed on 20th May, 2021 would suffice for the relief sought for the present, particularly with regard to the appearance of the petitioners.

If the petitioners are being represented under Section 205 of the Code of Criminal Procedure pursuant to the direction passed by the learned Magistrate, let the same continue and the trial be expedited so that the same may be taken to its logical conclusion. If the petitioners are appearing through their learned advocates, in that case as directed the earlier warrant of arrest dated 9.04.2021 be recalled by the learned Metropolitan Magistrate, 7th Court, Calcutta.

With the aforesaid observations, the revisional application being CRR 1312 of 2021 is disposed of.
