Kausik (Rejected) CRM (M) 1031 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Durgapur Police Station Case No. 378 dated 20.07.2024 under Section 126(2)/65(1) of the BNS, 2023 and Section 4/6 of the POCSO Act, 2012.

Affidavit of service filed be kept with the record. Learned advocate appearing for the petitioner submits that petitioner is in custody almost for about 2 years and till date only 17 witnesses have been examined out of the proposed 22 witnesses. According to the petitioner, the witnesses are not turning up and stretching the trial of the case, as such, the petitioner may be released on bail.

Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement under Section 183 of the BNSS as also the Medico Legal Examination Report.

I have taken into account the gravity of the offence and I am of the view that, this is not a fit case for releasing the petitioner at this stage.

Learned Trial Court would take steps so that within a period of 6 months rest of the witnesses are completed by the prosecution.

With the aforesaid observations CRM (M) 1031 of 2026 is dismissed.

Mr. Somnath Adhikary, learned advocate was directed to represent the State. His appearance be regularized by the concerned authorities.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
