The revisional application was preferred challenging the judgment and order dated 05th March, 2011 in Criminal Motion No. 04 of 2010 wherein the learned Additional Sessions Judge, 1st Court, Suri, Birbhum was pleased to affirm the order dated 05.09.2009 passed by the learned Chief Judicial Magistrate, Birbhum in Misc. Case No. 193 of 2007.
Record of the revisional application reflects that till date none represent the petitioner before this Court and the revisional application has been pending for more than 10 years. The subject matter of challenge relate to an order of interim maintenance of Rs.750/- per month and Rs.500/- per month awarded to the wife and the minor son respectively.
Having regard to the quantum of award for the purpose of interim maintenance, I am of the view that no interference is called for having regard to the present cost of living and the stage at which the order was passed by the learned Magistrate and subsequently affirmed by the learned revisional Court (being the Sessions Court). Accordingly, CRR 1489 of 2011 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
