Banerjee) Mr. Krishnendu Bera ...for the petitioner This revisional application under Article 227 of the Constitution of India is at the instance of the decree-holder praying for a direction upon the learned Civil Judge (Jr. Division) 1st Court, Arambagh, Hooghly to dispose of Title Execution Case No. 3 of 2009 expeditiously.
In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial judge.
Learned advocate appearing for the petitioner submits that the judgment-debtors/opposite parties herein are trying to drag the execution case.
From the order-sheets appended to this application this Court finds that July 21, 2025 has been fixed to enable the judgment-debtors to bring the stay order and in default necessary orders would be passed.
In the light of the submission made by the learned advocate for the petitioner, CO 1466 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Division) 1st Court at Arambagh, Hooghly to make an endeavour to dispose of the Title Execution Case No. 3 of 2009 as expeditiously as possible without granting any unnecessary adjournment to either of the parties provided, no order of stay of the execution has been passed by any competent court of law.
