Mr. Bikash Chowdhury Mr. Mahadev Sarkar ....For the petitioner Mr. Suman Sengupta Mr. D. Basu Mallick ....for the State Petitioner applied for license for FPS in terms of vacancy notification issued by the Sub-Divisional Controller, Food & Supply, Bolpur, District-Birbhum. Petitioner made a online application on 17th September, 2024. Thereafter, his proposed shop-cum-godown was inspected on 4th October, 2024. The petitioner called for personal interview by concerned District level fair price shop selection committee on 6th March, 2025. He approached the authority in terms of the personal interview notice but since then no result has been published. Hence the petitioner approach this court for necessary direction.
Heard learned counsel for the petitioner as well as the learned counsel appearing on behalf of the State it appears that the entire selection process was conducted by the authority in terms of the rule of relevant control order.
The personal interview by the District Level Fair Price Shop Selection Committee of the candidate is one of the part of the entire vacancy procedure. The petitioner being is one of the candidate cannot asked for the result of such personal interview. The District Level Fair Price Shop Selection Committee was given authority to call for personal interview of the candidate in respect of specified marks. According to the marksheet the most suitable candidate could be selected. The authority concerned could notify the same through portal.
Under the above observation, I am of the view that the instant writ petition is pre-matured one. The writ petitioner has no cause of action to file the instant writ petition. However, I make it clear that this court has not entered into the merit of this matter. The concerned authority shall conclude the selection process according to the rule laid down in the relevant control order.
Since no affidavits are exchanged between the parties, the allegation made in the writ petition shall be deemed to have been not admitted.
