1. Affidavit-of-service filed in Court today is taken on record. Despite service, the respondents are not represented.
2. The instant writ petition has been filed, inter alia, praying for disbursal of retiral benefits.
3. The learned advocate for the petitioner has drawn attention of this Court to the Pension Payment Order (PPO) dated 7th February, 2023 and would submit that the petitioner's husband was an employee of the Raiganj Municipality and had died intestate on 31st August, 2021. Subsequently, though a PPO has been issued in favour of the petitioner in her capacity as widow of the deceased, the concerned authorities are yet to favour the petitioner with the benefits. Though, the respondents are not represented despite service, however, taking into consideration the fact that matter pertains to disbursal of death benefits and a PPO has
already been issued, I am of the view that no fruitful purpose will be served by keeping the writ petition pending.
4. Accordingly the writ petition is disposed of by directing the concerned respondents to forthwith disburse the admissible dues payable to the petitioner in terms of the PPO. The entire admitted outstanding amount of gratuity as determined in the P.P.O., shall be disbursed in favour of the petitioner within a period of 4 weeks from the date of communication of this order. The same shall carry an interest @ 10% per annum calculated from the period when the same was payable till such time the same is actually paid.
5. Insofar as the pension is concerned, the concerned authorities shall disburse the arrear pension as may be found due along with interest @ 6% per annum as is payable till date.
6. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
