Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 350 days and is similarly situated as the other accused person, namely, Dil Kush Kumar, who has been granted bail in CRM(NDPS)498 of 2026. Mr. Sagar Saha, learned advocate, was directed to represent the State. He is present with the case diary. His appearance may be regularized by the concerned authority. Records of the case reflects that there were seizures of 258 grams of brown sugar from four persons which included the present petitioner as also the other accused who has been granted bail in CRM(NDPS)498 of 2026.

Having considered that the petitioner is similarly situated as the other accused person, the learned special court is directed to

release the petitioner, namely, Bikash Yadav on bail on the same terms and conditions as the accused who was released on bail in CRM(NDPS)498 of 2026.

Accordingly, CRM(NDPS)831 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
