The respondents are not represented despite service.
The petitioner claims to be a co-sharer in respect of the plot in question with the private respondent. A preemption suit filed by the petitioner is pending. An order of injunction has been granted by the learned trial Court restraining the opposite parties therein from transferring the scheduled property to any third party, causing any waste or damage therein and changing the nature and character of the same. The petitioner alleges that the Panchayat being the 2nd and 3rd respondents herein, have installed a pump and deep tube well in the plot in question illegally without obtaining permission of the co-sharers including the petitioner.
On prayer of the petitioner, liberty is granted to submit a comprehensive representation before the Pradhan, Baishata Gram Panchayat, being the 3rd respondent herein, ventilating his grievance, within a week from date. The third respondent is directed to consider and dispose of the same within four weeks
from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law.
The decision taken by the authority shall be communicated to the parties within a week thereof. The pump and the tube well in question shall not be operated till the disposal of the representation. The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
