Debasish Koley v. Parthana Koley @ Rubi

15.6.2023 Ct. 236 SB C.O. 735 of 2014 In the matter of : Debasish Koley None appears on behalf of the petitioner.

Since this application under Article 227 of the Constitution for modification of the order of alimony pendente lite passed by the learned Additional District Judge, 3rd Court, Hooghly in Mat. Suit No. 98 of 2012. On 23.6.2015 petitioner was directed to serve copy of the application.

It goes without saying that the petitioner being the husband has incurred the liability to maintain his wife and child and he is under statutory obligation to pay litigation cost. The quantum of alimony granted by the learned Trial Court appears to be neither penurious nor luxurious and does not warrant any interference from this Court.

With this aforesaid observation, the revisional application stands disposed of.
