Mr. Ekramul Bari Mr. Sk Imtiaj Uddin..........for the petitioner Mr. Saikat Chatterjee ...for the State Learned advocate for the petitioner as well as learned advocate for the State are present. The petitioner has moved the present writ petition challenging the alleged inaction on the part of the West Bengal Regional School Service Commission in recommending the name of the petitioner for appointment to the post of Assistant Teacher of Bengali (Pass) at Balakuti High School, Balakuti, Tufanganj, District Coochbehar in spite of the selection made by the Commission.

Mr. Bari, learned advocate appearing for the petitioner submits that the grievance of the petitioner has already been mitigated as the petitioner has been appointed during pendency of this writ petition. He has stated that taking into consideration the circumstances developed,

as before, during pendency of this case, necessary order may be passed.

Considered. On the basis of the facts as stated above and on perusal of the documents as submitted, this court is of the opinion that no further cause of action remains in this writ petition to be adjudicated upon.

Hence, this writ petition is disposed of being infructuous.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
