Learned counsel for the petitioner submits that petitioner passed away during pendency of the writ petition.

As such, the writ petition may be dismissed as infructuous. However, the son of the petitioner shall, instead of praying for substitution in the present case, be permitted to file a similar application on the selfsame grounds.

Accordingly, the writ petition is disposed of, however, without any order as to costs..

However, this order will not preclude the son of the petitioner from filing a fresh application on the selfsame grounds.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible.
