Learned advocate appearing for the petitioner submits that the daughter of the petitioner was murdered when she was pregnant at her matrimonial home. The police are not taking any steps despite the complaint lodged.

Learned advocate appearing for the State submits that the father of the victim obtained the body of the victim upon making a declaration that there was no foul play. The father of the victim did not lodge any police complaint. Subsequently the mother of the victim who is the petitioner herein submitted a complaint. On the basis of such complaint notices were issued to the father of the victim to clarify his stand. The father of the victim however, despite receipt of such notices, did not clarify his stand. Thereafter the police proceeded to lodge a First Information Report on May 29, 2021 inter alia under Sections 498A/302 of the Indian Penal Code. Four persons were arrested.

In such circumstances the police having acted on the basis of the complaint received no further interference is called for at this stage. No doubt the police will complete the investigation in accordance with law and submit their report before the jurisdictional Court as expeditiously as possible. W.P.A. 10575 of 2021 is disposed of accordingly. The parties shall act in terms of the copy of the order downloaded from the official website of this Court.
