By presenting this writ petition, inter alia, petitioners have prayed for arrear dues on sanctioning same which was not paid to their deceased father who was Headmaster of Jajan Kenaram High School (H.S.), Murshidabad.

Father of the petitioners died-in-harness on 27th January, 1998 but the arrear dues were not paid to him during his tenure and in connection thereto notice of this Court has been drawn to a document at page 20 of the writ petition.

On perusal of such document, it appears that Assistant Secretary to the Government of West Bengal, School Education Department vide memo dated 22nd November, 2021 requested the District Inspector of Schools (SE), Murshidabad being respondent no.5 to prepare a report relating to dues payable in connection with service of the

father of the petitioners.

Today State respondents are represented by learned advocate but nothing is produced before this Court from which it can be ascertained that necessary steps were taken by respondent no.5. In view of aforesaid situation, District Inspector of Schools (SE), Murshidabad is directed to decide the claim of the petitioners relating to arrear dues which were payable to their father who was Headmaster of a Government recognized aided secondary school.

Such decision is to be taken by respondent no.5 by twelve weeks from the date of communication of this order after granting opportunity of hearing to the petitioners or their representative and same shall be communicated to the petitioners by ten days thereafter.

With the aforesaid directions, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
