Heard learned counsels for the parties.

The petitioners are in custody for about 250 days and pray for bail.

Learned counsel for the petitioners submits that the petitioners are not the principal accused and they have only been used for the purpose of utilizing their bank accounts where some money was deposited.

Opposing the prayer, learned counsel for the State submits that an amount of Rs.69 lakhs was diverted in the account of the 2nd petitioner Sandip Dey out of which Rs.7 lakhs was further diverted to the account of co accused Partha Mondal. The petitioners are the beneficiaries of the entire transaction. Charges have been framed and dates fixed for examination of the witnesses.

I have considered the material on record. The material on record prima facie suggests direct involvement of the petitioners in the alleged offence which strikes at the economic security of the society at large.

Considering the nature and gravity of the offence and prima facie involvement of the petitioners therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
