Mr. Anand Keshari, Mr. Sekhar Mukherjee, Mr. Gaurav Kumar .....for the Petitioner The present revisional application has been preferred challenging the mode and manner in which complaint case No. C1707 of 2004 is progressing before the Learned Chief Judicial Magistrate, at Alipore.

I find that the case is under Section 138 of the Negotiable Instruments Act and till date the evidence of the case has not been completed after eighteen years.

Learned advocate contends that the accused has successfully managed to delay the trial. In view of the prolonged manner in which the case has proceeded I direct the Learned Trial Court to fix the date at least once in a week so that the case can be taken to its logical conclusion within a reasonable period of time. In case there is non-cooperation by either of the parties the learned Magistrate on each occasion would impose a cost of Rs.5000/-. All efforts must be taken so that the trial of the case is completed by May 31, 2023.

With the aforesaid observations, CRR 1715 of 2022 is disposed of.
