Adverting to order dated 19th March, 2022 passed in C.O. 3028 of 2019, learned advocate appearing for the petitioner submits that the learned Judge remaining in-charge of the court of learned Additional Principal Judge Family Court, in the absence of a regular Presiding Judge being posted there, is not sensitive to ensure expeditious disposal of pending litigation doing adherence to the direction, passed by this court as mentioned hereinabove. No other point is raised requiring address by this Court.

Admittedly there is no regular Presiding Officer posted in connection with Additional Principal Judge Family Court, Kolkata, wherein Matrimonial Suit No. 22 of 2018.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite party.

Service of notice of this application upon opposite party stands dispensed with.

Accordingly, learned Judge remaining in-charge of Additional Principal Judge Family Court, Kolkata in Matrimonial Suit No. 22 of 2018 is requested to ensure expeditious disposal of pending suit referred above, subject to his suitability and convenience, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable.

While endeavouring such exercise, the direction passed in CO No. 3028 of 2019 to ensure expeditious disposal may be kept in mind, and logical conclusion of the case may be reached accordingly.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
