And In Re : Safikul Halsana ..... petitioner Mr. Sudipta Kumar Bose Ms. Lipika Nath ... for the petitioner Mr. Neguive Ahmed, learned APP Ms. Amita Gaur ... for the State Learned Counsel appearing for the petitioner submits that he has been falsely implicated in the instant case. Learned Counsel appearing for the State submits that the petitioner had absconded and proclamation and attachment had been issued against him.

We have considered the statements of witnesses. It is alleged petitioner had earlier eloped with the wife of the victim and petitioner had threatened the victim. He had motive to commit the crime.

In view of the aforesaid facts, we are of the opinion that this is not a fit case to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. (Ananya Bandyopadhyay, J.) (Joymalya Bagchi, J.)
