Md. Anwar Hossain, Ms. Amita Gaur ..for the State The allegations against the petitioners are under Sections 364/368/302/201/120B of the Indian Penal Code. It is submitted on behalf of the State that the petitioners have been falsely implicated and are in custody for more than three years. None of the witnesses has implicated them in their statements recorded under Section 161 of the Code of Criminal Procedure.

State opposes the prayer for bail and draws attention of the Court to the statement of witnesses and seizure list. The mobile

phone of the deceased was seized from the possession of the petitioner no.1.

We have considered the material in the case diary. The allegations against the petitioners are extremely serious. Trial has commenced.

In view of the nature and gravity of the allegations as well as facts and circumstances of the case and that the trial has commenced, we are not inclined to grant bail to the petitioners at this stage.

The prayer for bail, is, thus rejected.
