The petitioner complains that the private respondent is obstructing in the flow of sewerage water from his premises. Complaint was lodged before the police but the police are reported not to have taken any steps in response to the same.

Learned advocate representing the State respondents has obtained instruction from the Prodhan of the Gram Panchayat wherefrom it appears that indeed the drainage system is not functioning properly because of illegal constructions.

The Gram Panchayat is directed to take all necessary steps to ensure that the drainage water in the area moves out freely without any obstruction from

any person whatsoever. Drainage water shall not be accumulated to prevent breeding of mosquitoes and other insects.

The police shall ensure that the nuisance in question is immediately removed and the drainage water can flow out smoothly.

Steps shall be taken in the matter at the earliest but positively within a period of four weeks from the date of communication of the order.

The writ petition stands disposed of.
