Saha, learned Advocate for the petitioner submits that the date of receipt of arrear pension and gratuity is November 05, 2020 but it has wrongly gone down in the writ petition as November 06, 2010.

The petitioner was an approved Librarian of a Library under the Department of Mass Education Extension & Library Services, on attaining the age of superannuation, she had retired from her said service on December 31, 2019.

The Pension Payment Order of the petitioner was issued on August 18, 2020, in pursuance whereof, she had received the gratuity and the arrear pension on November 05, 2020.

The petitioner is praying interest on the arrear pension and gratuity for the delayed payment.

Learned Advocate for the State respondent does oppose the prayer of the petitioner.

The law is now well-settled that for such delay in payment of pension and gratuity, the petitioner is entitled to interest.

The respondents, the concerned Treasury Officer in particular, therefore, are directed to pay interest @ 8% per annum on the arrear amount of pension and gratuity from the date of retirement of the petitioner till the date of such payment.

The payment as directed above shall be made within the period of eight weeks from the date of communication of this order.

W.P.A 9332 of 2025 stands disposed of with the above terms. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
