The petitioner was arrested on 21.05.2023 and was the owner of the truck from where six thousand bottles of phensedyl were recovered.

The report submitted by the Learned advocate for the State reflects that the evidence of the witnesses commenced on 7th June, 2024 and till date five witnesses have been examined.

The accused persons seems to have contributed to the delay in the progress of the trial as is reflected from the report. However, there is systematic delay also.

It has been submitted on behalf of the State that another five witnesses are required to be examined. Having considered that the petitioner is in custody for two years eight months and some more time will be required to take the trial to its logical conclusion, without entering into the merits of the case, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Manik Ghosh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, Barrackpore at North 24 Parganas.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of North 24 Parganas without prior intimation to the learned Special Court/trial court.

Accordingly, CRM (NDPS) 851 of 2026 is allowed. Pursuant to the direction dated 21.05.2026, the Investigating Officer of the case is present in court today.

His further appearance before this court for the day is dispensed with.
