No. 29 CHC Rejected C.R.M.(A) 1708 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Bagnan Police Station Case No. 655 of 2022 dated 12.12.2022 under Sections 448/323/325/354/379/506/34 of the Indian Penal Code, adding Section of the Indian Penal Code subsequently charge sheet under Sections 448/ 323/ 325/ 304/ 354/ 506/ 34 of the Indian Penal Code.

And In the matter of : Jushna Bar @ Jotshna Bar & anr. ...... petitioners Md. Sarwar Jahan, Mr. Maidul Islam Kayd, Mr. Sumit Naskar ....for the petitioners Mr. Arijit Ganguly, Mr. Avil Ghatak ....for the State Both the petitioners were involved in an incident of assault.

A person died in such incident of assault.

Eyewitness implicates three persons who assaulted the deceased. Role of the petitioners before us are stated to be one of provocation and/or throwing brick bat at the victims.

In view of the gravity of the offence and involvement of the petitioners in the incident, we are unable to grant anticipatory bail to the petitioners.

CRM (A) 1708 of 2023 is rejected.
