Learned advocate appearing for the petitioner submits that petitioner is similarly placed as the other accused person namely, Abdul Rahaman who has been granted bail in CRM (M) 735 of 2026. Learned advocate appearing for the State opposes the prayer for bail but is unable to refute the contention that petitioner is not similarly placed as the other accused.

In view of the aforesaid, petitioner be released on bail subject to satisfaction of learned A.C.J.M., Chanchal, Malda on same terms and conditions as was imposed upon Abdul Rahaman in CRM (M) 735 of 2026.

Accordingly, CRM (M) No. 1071 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
